Indemnity policies

Sometimes there are problems with a property, such as a lack of planning permission or building regulation's completion certificate for an alteration, or perhaps there are no access rights or unknown restrictive covenants which might affect your use of the property. These can sometimes be protected against with an appropriate insurance policy and the buyer may insist that you, as seller, provide or pay for the policy. If we consider such a policy is necessary we will inform you and advise you of the likely cost. We may also charge you an additional fee for our time spent in arranging the policy or policies.

How long will my house sale take?

It is difficult to be precise as to how long it'll take as there are a number of variables that can speed up or slow down any transaction. On average we would expect your sale to take six to eight weeks, but delays can arise where there is a chain, or issues arise concerning your property or third parties.

Stages of a sale include:

  • Taking your initial instructions

  • Obtaining any title deeds or copies of the title from the Land Registry

  • Contacting any lender to obtain a redemption figure

  • Preparing the contract and sending it to the buyer’s solicitor with the title and property information forms

  • Considering any amendments to the draft contract

  • Dealing with any questions raised by the buyer’s solicitor which concern the property

  • Approving the draft transfer.

  • Obtaining your signature to the contract, transfer and any other relevant documents

  • Dealing with exchange of contracts and preparing for completion

  • On completion receiving the sale proceeds, paying off any mortgage on the property, paying the estate agent’s bill and sending any balance to you

If any issues arise which mean that our fees will exceed the estimate given, we will discuss them with you so that you can decide how to proceed

Some of the things which can increase our fees are:

  • Advising on and obtaining indemnity policies

  • If the property is unregistered

  • Preparing a deed of covenant

  • Dealing with more than one firm of solicitors

  • Dealing with a lease variation or extension

  • Dealing with any Land Registry restriction

  • Paying off more than one mortgage or rent and service charge arrears

Purchase of a freehold residential property fees

Our fees cover all of the work* required to complete the purchase of your new home, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property you wish to buy is in Wales.

This depends on the purchase price of your property. You can calculate the amount you will need to pay by using HMRC's website or if the property is located in Wales by using the Welsh Revenue Authority's website.

How long will my house purchase take?

How long it will take from your offer being accepted until you can move in to your house will depend on a number of factors. The average process takes between 8-12 weeks.

It can be quicker or slower, depending on the parties in the chain. For example, if you are a first time buyer, purchasing a new build property with a mortgage in principle, it could take around 14 weeks. However, if you are buying a leasehold property that requires an extension of the lease, this can take significantly longer, between 2 and 4 months. In such, a situation additional charges would apply.

 

Stages of the process

The precise stages involved in the purchase of a residential property vary according to the circumstances. However, below we have suggested some key stages.

 

  • Take your instructions and give you initial advice

  • Check finances are in place to fund purchase and contact lender's solicitors if needed

  • Receive and advise on contract documents

  • Carry out searches

  • Obtain further planning documentation if required

  • Make any necessary enquiries of seller's solicitor

  • Give you advice on all documents and information received

  • Go through conditions of mortgage offer with you

  • Send final contract to you for signature

  • Agree completion date (date from which you own the property)

  • Exchange contracts and notify you that this has happened

  • Arrange for all monies needed to be received from lender and you

  • Complete purchase

  • Deal with payment of Stamp Duty/Land Tax

  • Deal with application for registration at Land Registry

This is a standard transaction and that no unforeseen matters arise including for example (but not limited to) a defect in title which requires remedying prior to completion or the preparation of additional documents ancillary to the main transaction. This is the assignment of an existing lease and is not the grant of a new lease

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as search fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. There are certain disbursements which will be set out in the individual lease relating to the Property. The disbursements which we anticipate will apply are set out separately below. This list is not exhaustive and other disbursements may apply depending on the term of the lease. We will update you on the specific fees upon receipt and review of the lease from the seller's solicitors

Anticipated Disbursements*

Notice of Transfer fee – This fee if chargeable is set out in the lease. Often the fee is between £50 - £150.

 

Notice of Charge fee (if the property is to be mortgaged) – This fee is set out in the lease. Often the fee is between £50 and £150

Deed of Covenant fee – This fee is provided by the management company for the property and can be difficult to estimate. Often it's between £250 and £400

Certificate of Compliance fee - To be confirmed upon receipt of the lease, as can range between £50 – £150

*These fees vary from property to property and can on occasion be significantly more than the ranges given above. We can give you an accurate figure once we have sight of your specific documents.

 

You should also be aware that ground rent and service charge are likely to apply throughout your ownership of the property. We will confirm the ground rent and the anticipated service charge as soon as this we receive this information.

In essence, remortgaging is the act of switching your existing mortgage to a new deal, either with your existing lender or a different provider. You’re not moving house and the new mortgage is still secured against the same property. Our fees cover all of the work required to complete the remortgage of your home, including acting for the new lender and dealing with registration at the Land Registry.

The precise stages involved in the remortgage of a residential property vary according to the circumstances. However, below we have suggested some key stages.

 

  • Taking your initial instructions

  • Investigating the title to the property, ensuring that you are entitled to mortgage the property, that the property has all necessary rights and is not subject to any restrictions which would impact the lender or affect their decision to lend

  • Carrying out the necessary searches and raising any issues with you. Searches can take several weeks to come back after we have requested them

  • Reporting to you on your mortgage

  • Obtaining your signature to the mortgage and any other relevant documents and obtaining any funds needed from you over and above

  • The new mortgage advance (if any)

  • Obtaining a redemption figure for any existing mortgages

  • Reporting to your bank and requesting the mortgage advance

  • On completion paying off any old mortgages, accounting to you for any balance, and dealing with registration of the new mortgage at the Land Registry

  • Sending you a copy of the new land registry title showing you as the owner
